Environment and Nuisance - Contaminated Land
Powys has a significant history of sites that are potentially contaminated. Examples include gasworks, quarries and landfill sites.
What is Contaminated Land?
Contaminated land is defined under Part 2A of the Environmental Protection Act 1990 as:
""any land which appears to the local authority in whose area it is situated to be in such a condition, by reason of substances in, on or under the land, that
a) significant harm is being caused or there is a significant possibility of such harm being caused; or
b) pollution of controlled waters is being, or is likely to be, caused."
What is Powys County Council doing about Contaminated Land?
Local Authorities are required by law to inspect their areas to identify Contaminated Land. If Contaminated Land is found, the council must take steps to control the risks caused by the contamination. Essentially, the legislation is aimed at finding land which is so contaminated that it needs to be cleaned up in the interests of the public and the wider environment.
In January 2017, Powys County Council published a revised version of its Inspection Strategy that takes into account revised statutory guidance and sets out the council's approach to assessing Contaminated Land.
